Transfer of undertakings

The rules on the transfer of undertakings may be applicable in several different situations, for example when an employer transfers his operations or part of his operations to another employer. An assessment must be made of all the circumstances of the individual case in order to assess the applicability of the rules for the transfer of undertaking. The key provisions are set out in Section 6 b and Section 7 of the Employment Protection Act and in Section 28 of the Co-determination Act. In this section we describe in more detail what the employer should think about.
